Ofqual's Own Lawyers: "We Don't Do SEN!"

Their own legal team confirmed: "Ofqual has no duties under Part 3 of the Children and Families Act 2014" and "the SEND Code of Practice does not apply to Ofqual".

Despite ministerial claims that "Ofqual can oversee SEN qualifications," their solicitors have now legally confirmed: the Regulated Qualifications Framework was never designed for SEN/EHCP learners.

Every day without LUNA SEN Regulator, children with autism, ADHD, dyslexia, and other needs are forced into a system that admits it wasn't designed for them. This isn't about "reasonable adjustments" - it's about fundamental design failure that's destroying futures daily.

We demand government recognition, authorisation, and implementation of the LUNA SEN Regulator as England's official SEN regulator - working parallel to Ofqual with the LSRQF (LUNA SEN Regulated Qualifications Framework) designed specifically for SEN/EHCP learners.

  • Children & Families Act 2014 Part 3: SEN/EHCP legal duties unfulfilled for 10+ years since RQF implementation (2015).
  • Equality Act 2010: Section 19 (sustained indirect discrimination), Section 149 (ongoing Public Sector Equality Duty breach).
  • SEND Code of Practice: Statutory guidance not enforced for SEN learners for over a decade.
  • Human Rights Act 1998: Protocol 1 Article 2 (ongoing breach of right to education), Article 14 (sustained discrimination).
  • UNCRPD Article 24: Persistent failure to provide inclusive education system for 10+ years.

The remedy

  • Recognise the LUNA SEN Regulator as England's official SEN regulator.
  • Authorise the LUNA SEN Regulator to operate parallel to Ofqual.
  • Implement the LUNA SEN Regulated Qualifications Framework (LSRQF) designed specifically for SEN/EHCP learners.
